The STAT Search Analytics Win AirPods Max Contest (the “Promotion”) is sponsored by Moz Holdings Canada Inc. (“STAT”). NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED. By entering the Promotion, entrants agree they are bound by and will comply with these rules (the “Official Rules”).
ELIGIBILITY: Promotion is open to legal residents of Canada, the 50 states of the United States of America, and the District of Columbia, who in each case, have reached the age of majority in the jurisdiction in which they reside at the date of entry. Employees, officers, directors, agents, and representatives of STAT and its affiliates, advertising and promotion agencies and all family members and persons residing in the same household thereof (collectively, “Related Parties”), are not eligible to win a Promotion prize.
PROMOTION PERIOD: Promotion will begin at 9:00am (PST) on August 7, 2023 and will end at 5:00 pm (PST) on August 8, 2023 (the “Promotion Period”).
HOW TO ENTER: Find the STAT booth at the MozCon conference, taking place August 7, 2023 and August 8, 2023 at the Seattle Convention Center Summit building, in Seattle, WA, between the hours of 9:00 AM and 5:00 PM on either day. Get a free STAT t-shirt (quantities limited and will be given based on a first come, first served basis) at the booth and take a photo of yourself wearing the STAT t-shirt (the “Photo”). During the Promotion Period: Tweet (publish) the Photo publicly using your Twitter account using the hashtag #MozCon and mention @getSTAT in your Tweet. Each Tweet that meets these conditions will each count as one entry, and contestants can submit a maximum of 2 such entries, in aggregate, during the Promotion Period. All entries beyond the first 2 will be disregarded, without notice. A valid Twitter account is required to enter, which entrants may set up by visiting www.twitter.com.
PRIZES: One winner will be selected each day of the Promotion Period for a total of two (2) winners during the Promotion Period – one each day; each winner will receive an AirPods Max, an approximate value of USD $549.00. EACH WINNER IS SOLELY RESPONSIBLE FOR ALL FEDERAL, STATE, PROVINCIAL AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF THE PRIZE. Limit one prize per household or address.
WINNER SELECTION AND NOTIFICATION: On each of August 7 and 8, 2023, at 5:30 PM, STAT will select one entrant by a random draw from all current eligible entries published during the Promotion Period and remaining publicly available on Twitter to STAT at the time of the draw. The entrant chosen for each day will be notified on or about the day of the draw, August 7 and 8, 2023 through their Twitter account or email address. Selected entrants must follow the instructions contained in the notification to claim a prize. Odds of winning depend on the number of eligible entries received. There is no particular regional allocation of the prizes: all eligible entrants will be eligible to win the prize.
Prizes returned as undeliverable or otherwise not claimed within 10 days after delivery of notification will be forfeited and awarded to an alternate winner. STAT may require the winners to sign an affidavit of eligibility, liability release, publicity release, and acceptance of these Official Rules to receive a prize. If the identity of an online entrant is disputed, the authorized account holder of the Twitter account or email address in question at the time of entry will be deemed to be the entrant. Prizes are non-transferable, non-exchangeable and non-refundable by the winner, have no cash value and must be accepted by the winner as awarded. However, STAT reserves the right to substitute a prize of equal or greater value in the event that the specified prize is unavailable due to circumstances beyond their control.
PUBLICITY AND PRIVACY: Please visit https://moz.com/privacy-policy to learn more about STAT’s privacy policy, including how it collects, uses and discloses personal information. By entering the Promotion, entrants consent to the collection, use and disclosure of their Photo, name, city of residence, likeness, voice, comments and prize information (collectively, the “Information”), without limitation, in connection with the Promotion and for STAT’s promotional purposes, without further permission or compensation. Without limiting the preceding consent, entrants acknowledge that STAT may disclose the entrant’s personal information to STAT’s third-party agents and service providers in connection with any of these permitted activities. Entrants understand that if they register on the Twitter website or application or submit information to or via Twitter such submissions are also subject to Twitter’s privacy policy.
Additionally, by entering the Promotion, entrants represent and warrant to STAT that: (a) all rights in and to the Information are owned by the entrant or the entrant has full authority by way of royalty-free, perpetual, worldwide and irrevocable licenses, permissions, waivers and consents to use (and authorize use of) the Information as contemplated in the Official Rules (including the publication of a Photo containing the likeness of any person other than the entrant); (b) the Information is true, accurate, and not misleading; and (c) the entrant’s Photo does not contain any unlawful, hateful, objectionable, harmful, threatening, abusive, harassing, offensive, libelous, defamatory, slanderous, immoral, pornographic, indecent, or obscene material, or material that is discriminatory (as relating to race, ethnicity, sexual orientation, age, religion, or other grounds) or that is otherwise objectionable or infringes any third-party rights. All entrants agree to take, at STAT’s expense, any further action (including executing documents) requested by STAT to effect, perfect or confirm the rights provided in this section.
RELEASES AND DISCLAIMERS: By entering the Promotion, entrants release STAT and its Related Parties from any liability whatsoever, and waive all causes of action related to claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Promotion or with the delivery or mis-delivery, acceptance, possession or use of any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injury, death, or damage to or loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or otherwise (“Claims”). By entering the Promotion, entrants also agree to fully indemnify STAT and its Related Parties and hold each of them harmless from any and all claims costs, losses, or damages of any kind arising out of or in connection with the Promotion, including any use or enjoyment of any Prize, by any third parties. STAT and its Related Parties are not responsible for any electronic, hardware or software program, network, Internet or computer malfunctions, failures or difficulties of any kind, or any late, lost, illegible, incomplete, damaged or misdirected entries. Although STAT may monitor or review the quality or nature of Photos from time to time, it is under no obligation to do so.
Notwithstanding anything to the contrary, in no event will STAT or a Related Party be liable to any entrant for any indirect, incidental, consequential or punitive damages, including damages for pure economic loss, and in no event will the total aggregate liability of STAT and a Related Party to any entrant exceed the lesser of: (a) the direct damages suffered or incurred by such person; or (b) the sum of USD $50.00, whether arising under a theory of contract, tort (including negligence), warranty or otherwise. The Promotion is in no way sponsored, endorsed or administered by, or associated with Twitter, Apple or the organizers of the MozCon conference (collectively, the “Third Parties”). Participation or entry into the Promotion constitutes a complete and irrevocable release of the Third Parties by each entrant of all causes of action related to all Claims.
GENERAL: The Promotion is subject to all federal, provincial, state and local laws and regulations. The Promotion and these Official Rules will be governed and interpreted under the laws of the state of New York applicable therein, without regard to any choice of law or conflict of laws rules. Except where prohibited, entrants agree that any and all disputes, claims and causes of action arising out of, or connected with the Promotion, or any prize awarded or any use of any prize awarded shall be resolved individually, without resort to any form of class action claim. STAT reserves the right to change these Official Rules or terminate the Promotion at any time in an effort to maintain or improve the fairness or integrity of the Promotion. Entrants who: violate these Official Rules; who violate any law, rule or regulation in connection with participation in the Promotion; who tamper with the operation of the Promotion; or who engage in any conduct that is detrimental or unfair to STAT, the Promotion or any other entrant; are subject to disqualification. STAT decisions with respect to the Promotion are final and binding. If any provisions of the Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
